On December 12, 2019, the City of Hayward filed an ex-parte application to appoint Gerard F. Keena II from Bay Area Receivership Group as Receiver over the Property commonly known as 22330 Main Street in Hayward, California, which created Alameda County Case #HG19046792. The Property is the former site of a college, a hospital, and several office buildings, which have been abandoned for years.
On December 18, 2019, the City of Hayward’s ex-parte application was heard, but the Owners of the Property, which has over $10,000,000 in mortgages against it filed for bankruptcy before the hearing. The Owner tried to argue that the bankruptcy prevented the receivership from moving forward, however the Police Power exception under 11 U.S.C. 362(b)(4) supersedes bankruptcy protection and Gerard Keena of Bay Area Receivership Group was appointed over the Property. Now the hard work of abating the significantly dangerous conditions at the Property begins.
